Terms of Service
The terms for using Everyframe and its apps, and for sending your videos to other platforms.
Draft of 23. 10. 2026 · JT-TOS-20261023-01
This is a draft. Our lawyers are still reviewing it, so it may change before it takes effect.
These Terms of Service (the “Terms”) govern your access to and use of Everyframe, an online service for making, editing, and publishing video with the help of AI, operated by JT Digital d.o.o., Stantetova ulica 10, 2000 Maribor, Slovenia, company registration number 7423268000, VAT ID SI42228441 (“JT Digital”, “we”, “us”). By creating an account or using Everyframe you agree to these Terms.
1. The Service
Everyframe is a set of video tools in one account: an AI agent that plans and makes videos from a brief and your own material; Composer, which makes many versions of an advert from one set of footage and copy; Cut, an editor for trimming and combining clips with transitions, text, sound, and music; and a library that holds your files. Everyframe can also send a finished video to a social network or an advertising account you have connected. It is offered at everyframe.si and composer.everyframe.eu, which are the same service under these Terms. The exact features available to you depend on your plan. We continuously improve the Service and may add, change, or remove features; where a change materially reduces the core functionality of a paid plan, we will notify you in advance.
2. Accounts and Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Everyframe. You are responsible for your account credentials and for all activity under your account. Keep your registration data accurate and notify us promptly of any unauthorized use of your account.
3. Plans, Billing, and Cancellation
During early access Everyframe is free of charge. We will introduce paid plans only after telling you, and nothing is charged unless you have agreed to a price. Prices shown on our websites before then are not an offer to you under these Terms.
If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from distance contracts. By starting to use the paid digital service within that period, you request immediate performance and acknowledge that you lose the right of withdrawal to the extent the service has been performed.
4. Your Content
You retain all rights to the materials you upload and to the outputs generated from them for you (“Your Content”). You grant JT Digital a non-exclusive, worldwide license to host, store, process, reproduce, and transmit Your Content solely to the extent necessary to operate, secure, and support the Service. We do not use Your Content to train or improve machine-learning models. The AI providers that process Your Content to give you a result are named in the Privacy Policy (“AI Providers”).
You are responsible for Your Content. You warrant that you hold all rights, licenses, and consents needed for the materials you upload (including music, footage, logos, and the likenesses of identifiable persons) and that Your Content does not violate applicable law or third-party rights.
5. Early Access
Everyframe is in early access. Some accounts are opened by invitation or from a waiting list, and the apps each account can use are switched on one by one. Features may be incomplete, may change, and may be withdrawn. Usage is limited in ways the Service shows you, such as the size of a file, the storage your account holds, and how much an agent run may spend on AI models; we may change these limits as early access goes on.
Early access is offered as is. Where a feature is labelled as a preview or is free of charge, the limits of liability in “Disclaimer and Limitation of Liability” apply to it in full, and we may end it at any time.
6. AI Features and Generated Output
Everyframe uses AI models, ours and those of the providers named in the Privacy Policy, to understand your instructions, plan and edit videos, transcribe and caption speech, clean up sound, and generate images, video, voice, and sound effects. What the Service produces this way is Generated Output, and it is part of Your Content.
AI models make mistakes. Generated Output may be inaccurate, incomplete, or unexpected; a transcript may mishear a word, an edit may cut the wrong moment, and a generated image may contain things you did not ask for. Similar prompts may give similar output to other users, so Generated Output is not unique to you. We do not promise that Generated Output is free of third-party rights, or that it is protected by copyright, which in many countries does not arise in material made without enough human creative input. Review every video before you publish or use it.
To the extent we hold any rights in Generated Output made for you, we assign them to you. Some models carry their own conditions of use, which we pass on to you where they apply; the Service tells you when a model has such conditions.
The agent works for you within the limits you set. It may spend from your account’s allowance for AI models only up to the budget the Service shows you, and it never sends, publishes, or uploads anything to a Connected Platform: only you do that, by pressing Send.
7. Synthetic Media and Disclosure
You must not use Everyframe to make a person appear to say or do something they did not, to copy a real person’s face or voice, or to impersonate anyone, unless that person has given you their consent and the result is lawful.
Where you publish image, audio, or video content made or changed with Everyframe that resembles real people, objects, places, or events and would falsely appear to a person to be authentic, you must disclose that it has been artificially generated or manipulated, as Article 50(4) of Regulation (EU) 2024/1689 (the AI Act) requires of the person who publishes it. For evidently artistic, creative, satirical, or fictional work, the disclosure may be made in a way that does not spoil the work. Where a Connected Platform asks you to label AI-generated or altered content, you must use its label.
Where the law requires it, we mark Generated Output as artificially generated in a machine-readable way, for example in the file’s metadata. You must not remove or alter such a mark.
8. People in Your Content
Videos often show people. You are responsible for having the rights and consents needed for every person who appears or is heard in Your Content, for the purposes you use it for, including publishing it and using it in advertising.
Where Your Content contains personal data about other people, you decide why and how it is processed and you are its controller; we process it on your behalf as your processor. For that processing we:
act only on your documented instructions, which are your use of the Service, your settings, and these Terms, unless Union or Slovenian law requires otherwise, in which case we tell you first unless that law forbids it;
ensure that the people we authorise to process it are bound to confidentiality;
take the security measures described in the Privacy Policy (“Security”);
use only the sub-processors named in the Privacy Policy, tell you about a new one before it starts, and let you object; where you object and we cannot reasonably accommodate it, you may end these Terms;
bind each sub-processor to obligations equivalent to these;
help you, as far as we reasonably can, to answer requests from the people concerned and to meet your obligations on security, breach notification, impact assessments, and prior consultation;
tell you without undue delay after we become aware of a personal data breach affecting Your Content;
delete Your Content at the end of the Service, as “Termination” describes, unless the law requires us to keep it; and
give you the information needed to show that we meet these obligations, and allow for and contribute to reasonable audits, on reasonable notice and at your cost.
Where you use Everyframe for a business, these terms are the data processing agreement between us under Article 28 GDPR. A separate data processing agreement is available on request, and prevails over these Terms on data protection where the two differ.
9. Connected Platforms
You can connect Everyframe to accounts you hold on other services, such as a YouTube channel, a Google Ads account, an Instagram account, a Facebook Page, a Meta ad account, a TikTok account, a TikTok ad account, a LinkedIn profile or page, or an X account (a Connected Platform). Which services can be connected depends on what the Service offers at the time; some are added only after the service in question has approved Everyframe.
When you connect an account, you sign in with that service and it asks you to allow Everyframe certain kinds of access. You authorise us to use that access only to do what you ask, which is:
to upload and publish the videos you send, with the title, caption, privacy setting, and other details you choose;
to add a video to an advertising account’s library, so that you can use it in your own adverts;
to check the status of what we sent and show you the result, such as a link to the post or the reason the service refused it; and
where you turn it on, to read the performance of what was sent, so that the Service can show you how each version did.
We send only when you press Send. Before you press it, the Service shows you what will go where and with what text. We never post or upload on our own initiative, and we never create campaigns, set budgets, or spend money in an advertising account: any advert you run with a video we uploaded is yours, between you and the advertising service.
You are responsible for what you send and where you send it, and for following the terms and policies of each Connected Platform, including its rules on advertising, branded content, music, and the labelling of AI-generated content. Your use of a Connected Platform is governed by its own terms, to which we are not a party. A Connected Platform may refuse, remove, or limit a post, change or withdraw the access it gives us, or suspend your account there, and we are not responsible for what it does. We do not promise that a post is published at a particular time, or at all.
YouTube. Everyframe uses the YouTube API Services. By connecting a YouTube channel or sending a video to YouTube, you agree to be bound by the YouTube Terms of Service (youtube.com/t/terms).
You can disconnect an account at any time in Everyframe, and you can also withdraw our access in the Connected Platform’s own settings. Either way we stop using the access and delete it, as the Privacy Policy describes. What you already published stays on the Connected Platform until you delete it there. If a connection stops working, sends to it wait and the Service tells you.
10. Your Library and Keeping Copies
Everyframe stores your files so that you can work with them, but it is not a backup service. Keep your own copies of anything that matters to you. Previews, drafts, and other intermediate files the Service makes may be deleted after a period the Service shows you. When you delete something, we cannot restore it.
If you belong to an organisation in Everyframe, what you share with it can be seen by its other members. You decide what you share, and you can stop sharing at any time.
11. Acceptable Use
You must not:
use the Service to create or distribute content that is unlawful, defamatory, harassing, or that infringes intellectual property, privacy, or publicity rights;
upload malware or attempt to probe, disrupt, or gain unauthorized access to the Service or its infrastructure;
reverse engineer, scrape, resell, or provide the Service to third parties as your own, except as expressly permitted;
circumvent usage limits, metering, or security measures;
use the Service to create deceptive synthetic media of real persons without the disclosures and consents required by applicable law.
We may suspend or terminate accounts that violate this section.
12. Intellectual Property
The Service itself — including its software, processing and rendering engines, models, interfaces, design, and know-how — is and remains the exclusive property of JT Digital and its licensors. Except for the rights expressly granted in these Terms, no rights in the Service are transferred to you.
13. Privacy
Our processing of personal data is described in the Everyframe Privacy Policy, which forms part of your agreement with us. We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Slovenian data protection law.
14. Availability and Support
We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. Planned maintenance and factors outside our reasonable control (including outages of third-party infrastructure) may affect availability. Support is provided on a commercially reasonable basis through the contact channels listed below.
15. Disclaimer and Limitation of Liability
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, JT Digital disclaims all implied warranties, and our total aggregate liability arising out of or in connection with the Service is limited to the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. To the same extent, we are not liable for indirect or consequential loss, for loss of profits, revenue, goodwill, or anticipated savings, or for loss of or damage to data. Separately, we are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control. Nothing in these Terms limits liability for intent or gross negligence, or any liability that cannot be limited under applicable law, including mandatory consumer rights.
16. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for material breach of these Terms, and will, where proportionate, warn you first. Upon termination we will make Your Content available for export for a reasonable period, after which it will be deleted from active systems in accordance with the Privacy Policy.
17. Changes to These Terms
We may update these Terms from time to time. For material changes we will give you at least 15 days’ notice by email or in-app notification before the new Terms take effect. If you do not agree with the updated Terms, you may cancel before they take effect; continued use after the effective date constitutes acceptance.
18. Notices
Notices under these Terms are given in writing. We may notify you by email to the address registered for your account or by a notice in the Service; you notify us by email to the address in “Contact” and, for notices of termination, breach, or a claim, also by post to our registered address. An email notice is treated as received on the next working day after it is sent, unless the sender receives a delivery failure.
19. Feedback
Where you give us suggestions or feedback about the Service, we may use them without restriction and without obligation to you. We will not identify you as their source without your consent. Feedback does not include Your Content.
20. Force Majeure
Neither of us is liable for a failure or delay in performing an obligation, other than an obligation to pay, caused by an event outside our reasonable control, including natural events, war, civil unrest, industrial action, failure of public communications networks or utilities, and the failure or unavailability of third-party infrastructure. The affected party informs the other without undue delay and uses reasonable efforts to work around the event. If the event continues for more than 30 days, either of us may terminate the affected part of the Service on written notice.
21. Assignment
You may not assign or transfer these Terms, in whole or in part, without our prior written consent, which we will not unreasonably withhold; consent is not needed to transfer to a successor of your business by merger or by acquisition of substantially all of your assets, provided you tell us. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition, or transfer of the business to which the Service belongs. Any other assignment is void.
22. Entire Agreement, Waiver, and Severability
These Terms, together with the documents they incorporate — the Privacy Policy, your plan or order form, any data processing agreement, and any SDK licence — are the entire agreement between us on their subject matter and replace any earlier representation, proposal, or arrangement about it. Nothing in this paragraph limits liability for fraud. A variation is effective only if agreed in writing, except where these Terms allow us to make a change unilaterally.
A failure or delay in enforcing a provision is not a waiver of it, and a waiver on one occasion is not a waiver on another. If a provision is held invalid, unlawful, or unenforceable, it is severed or limited to the minimum extent necessary and the rest of these Terms remain in force; where severance would defeat the commercial purpose of the provision, we will replace it with a valid provision achieving as nearly as possible the same result.
23. Survival
The following survive termination: “Your Content” as to material still held, “Intellectual Property”, any indemnity, the disclaimers and limits of liability, confidentiality obligations, and any provision that by its nature is intended to survive, together with the accrued rights and liabilities of both of us.
24. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Slovenia. Disputes that cannot be resolved amicably fall under the jurisdiction of the competent court in Maribor, Slovenia. If you are a consumer, you also benefit from any mandatory provisions of the law of your country of residence, and you may use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
These Terms are concluded in English. Any translation we provide is for convenience only and the English text prevails, except where you are a consumer and the law of your country of residence requires these Terms to be made available in another language, in which case that version prevails to the extent of that requirement.
